By using the Service, you represent and warrant that:

• You are legally permitted to use the Service in the United States
• You have not been previously banned or removed from the Service

MisfitMatch is intended for United States residents only at this time.

2. Account Registration

To use certain features of the Service, you must create an account.

You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your login credentials
• Be responsible for all activity occurring under your account

MisfitMatch is not responsible for unauthorized access to your account resulting from your failure to safeguard your credentials.

3. Purpose of the Service

MisfitMatch is a matchmaking and dating platform designed to help users connect based on compatibility, shared values, lifestyles, and preferences.

MisfitMatch does not guarantee matches, connections, relationships, or outcomes of any kind. Compatibility scores and match suggestions are algorithmic and informational only.

4. User Conduct

You agree not to:

• Harass, threaten, abuse, or harm other users
• Impersonate another person or entity
• Post false, misleading, or deceptive content
• Share explicit, illegal, or exploitative material
• Use the Service for commercial solicitation
• Circumvent safety features or access restrictions
• Attempt to reverse engineer or disrupt the Service

MisfitMatch reserves the right to investigate and take appropriate action, including account suspension or termination, for violations of these Terms.

5. Content You Provide

You retain ownership of the content you submit, including profile information, photos, and messages ("User Content").

By submitting User Content, you grant MisfitMatch a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute such content solely for operating and improving the Service.

You represent that:

• You own or have rights to the content you upload
• Your content does not violate laws or third-party rights

MisfitMatch may remove User Content at its sole discretion.

6. Safety and In-Person Interactions

MisfitMatch does not conduct background checks or verify user identities beyond provided information.

You acknowledge that:

• Interactions with other users occur at your own risk
• MisfitMatch is not responsible for user behavior online or offline

Animal and Exotic Pet Disclaimer

MisfitMatch is not responsible for injuries, damages, allergic reactions, property damage, or incidents involving animals, including exotic pets, resulting from user interactions.

You are solely responsible for exercising caution, judgment, and personal safety when meeting others or interacting with animals.

7. Subscriptions and Payments

MisfitMatch offers free and paid subscription plans, including:

• Monthly subscriptions
• Prepaid multi-month subscriptions
• Promotional free trials or Founding Member offers

Payments are processed through Stripe.

By purchasing a subscription:

• You authorize recurring charges unless canceled
• Subscriptions automatically renew unless canceled before the renewal date

Cancellations and Refunds

• You may cancel your subscription at any time
• Access remains active until the end of the billing period
• Fees are non-refundable unless required by law
• Promotional or free trial periods may convert to paid subscriptions unless canceled prior to expiration

8. Free Tier Limitations

Free users may have limited access to features such as messaging, likes, or visibility.

MisfitMatch reserves the right to modify free and paid feature availability at any time.

9. Termination of Accounts

MisfitMatch may, at its sole discretion and with or without notice, suspend or terminate your account if:

• You violate these Terms
• You engage in harmful or inappropriate behavior
• Continued access poses risk to other users or the platform

You may terminate your account at any time.

10. Intellectual Property

All trademarks, logos, software, and proprietary content on the Service are owned by or licensed to MisfitMatch.

You may not copy, modify, distribute, or create derivative works without written permission.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available."

MisfitMatch makes no warranties regarding:

• Match success
• Compatibility accuracy
• User conduct
• Service availability or reliability

12. Limitation of Liability

To the maximum extent permitted by law, MisfitMatch and Solo App Lab LLC shall not be liable for:

• Personal injury
• Emotional distress
• Property damage
• Lost data or profits
• User interactions or outcomes

Our total liability shall not exceed the amount paid by you to MisfitMatch in the preceding twelve (12) months.

13. Arbitration and Class Action Waiver

You agree that any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, not in court.

You waive the right to participate in class actions or representative proceedings.

Arbitration shall be conducted in accordance with applicable arbitration rules and governed by Ohio law.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles.

15. Changes to These Terms

MisfitMatch may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
